CLOSED SESSION ANNOUNCEMENT  
The City Council convened in closed session on February 17, 2026, at 6:00 p.m., with Council  
Member Syrop absent and six members present, and no public speakers, regarding conference  
with legal counsel, pursuant to Government Code section 54956.9(d), pending litigation, Caleb  
Smith, et al. v. City of Hayward, et al. United States District Court case no. 4:21-cv-08467 YGR.  
The City Council unanimously, with Council Member Roche moving and Council Member  
Andrew seconding, added pending litigation - Garden of Eden, et al. City of Hayward, Phenos, et  
al. to the closed session, as the matter came to the City's attention after the agenda was posted.  
City Attorney Lawson reported that the City Council conferred with legal counsel regarding the  
two pending litigation items and took no reportable action. The closed session was adjourned  
at 6:40 p.m.
